It’s called “Reasonable Doubt.”
On Thursday, Brooke Skylar Richardson, 20, was acquitted of aggravated murder, involuntary manslaughter and child endangerment charges by the Warren County jury which only deliberated for four hours.
Although Brooke was acquitted of those charges, she was found guilty of corpse abuse and will be sentenced on Friday. That guilty charge maximum is one year in prison but could get probation as she’s a first-time offender.
The burden of proof (namely that the child was born alive and not stillborn as this girl stated) is upon the People, not the accused. The prosecutor failed to prove that allegation. The evidence wasn’t there for the jury to make a finding on the most serious of the charges.

I heard about the trial on CourtTV periodically and my biggest question is when she went to the doctor who told her she was 32 weeks pregnant, the doctor would surely have noticed if the baby was not alive at that point. I have serious doubts the infant was stillborn only three weeks later. Not saying it couldn’t happen, but seems very unlikely.

A young Ohio mother who prosecutors said killed and buried her unwanted newborn in her backyard just days after her senior prom so that she could keep her “perfect life” was acquitted of murder Thursday.
Brooke Skylar Richardson, now 20, began shaking and sobbing while a judge read the not guilty verdicts on aggravated murder, involuntary manslaughter and child endangerment charges.
She had faced up to life in prison if she had been convicted on the most serious charge.
Richardson, though, was found guilty of corpse abuse by the Warren County jury that deliberated for four hours. She’ll be sentenced Friday. The charge carries a potential sentence of up to one year in prison, but as a first-time offender, she could get probation.
Richardson was walked out of the courtroom in handcuffs after Warren County Judge Donald Oda II revoked her bond. She and her mother exchanged tearful “I love you’s'” as deputies led her away. [Associated Press]
The case was unwinnable for the prosecution. When the coroner could not give a cause of death, any chance of getting around reasonable doubt went out the window. They had vapid texts from a teenager that shows she was shallow and uncaring. Doesn’t make her a murderer. Most they could get was an abuse of a corpse, which she may not even see jail time for. She probably got away with murder, but if you don’t have evidence of a murder, you can’t convict someone of it.

This is sad all around. I would have like to see the father of the baby there too. Why? Boys, Men need to be accountable why should the female have to carry the guilt. Why can’t he wear a scarlet letter of some kind? Young girls do not know much about babies? They have no idea when the family does not give knowledge or lives in a land of roses. Some girls just don’t know what a baby is, seriously, no idea what they are. She will be in therapy for or at least I hope that was what was required.
The justice system is so flawed. Women are innocent even if proven guilty and men are guilty even if proven innocent.
